IMPORTANT-READ CAREFULLY: BY EXERCISING YOUR RIGHTS TO MAKE AND USE COPIES OF THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU ARE NOT AUTHORIZED TO USE THE SOFTWARE.
1. LICENSE:
ELSINORE grants the licensee the following rights under this Evaluation License solely for the purposes of demonstrating, testing, and evaluation. Licensee may install the enclosed software on computer workstations, or in a network server environment. Licensee may not reverse engineer, decompile, or disassemble the Software, except to the extent such foregoing restriciton is expressly prohibited by applicable law. Licensee may not rent, lease or transfer the Sofware. Elsinore reserves all rights not expresssly granted herein. Licensee's right to use the Software shall be effective from the date licensee first installs the software for a period of 30 days. The Software is time sensitive and will not function upon expiration of the 30-day period.
2. COPYRIGHT:
The software and all other materials contained within the software package are the sole property of ELSINORE and are protected by the United States copyright laws and international treaty provisions. The software may be copied so long as the provisions above are followed, but (any) accompanying materials (manual, quick reference card, etc.) may not be reproduced in any form.
3. NO WARRANTIES
The software and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose. The entire risk, arising out of use or performance of the software remains with you.
4. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
In no event shall Elsinore or its suppliers be liable for any damages whatsoever, including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this software, even if Elsinore has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
5. U.S. GOVERNMENT RESTRICTED RIGHTS
The software and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 pr subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19, as applicable.
